A dispute over whether Lindsay Clancy intends to provide testimony has emerged in the civil litigation against the medical providers who treated her. The conflict surfaced during a hearing held Wednesday in Norfolk County Superior Court, where opposing legal teams presented conflicting accounts of her participation in the case.

Howard Cooper, the attorney representing Patrick Clancy, stated that he expects Lindsay Clancy to take the stand. Cooper argued that once the question of her Fifth Amendment privilege is settled, she will provide testimony. He told the court that she would explicitly state she had informed the defendants she possessed homicidal ideation and feared a terrible event involving her children.

Kevin Reddington, Lindsay Clancy's attorney, rejected this characterization. In a written statement, he clarified that his client has never indicated an intention to testify in Patrick Clancy's lawsuit. He further asserted that she never communicated to her healthcare providers that she harbored homicidal thoughts toward her children. Reddington emphasized that no one acting on her behalf had represented that she would speak.

The civil lawsuits were filed by both Lindsay and Patrick Clancy against various hospitals and healthcare providers. The plaintiffs allege that failures in medical care contributed to the deaths of their three children: Callan, Cora, and Dawson. The defendants have moved to dismiss the suits. Their legal argument rests on the claim that Lindsay Clancy never disclosed having homicidal thoughts to the doctors who treated her.

The civil cases stem from a 2023 tragedy in which the three children, all under the age of six, were found strangled at the family home. Lindsay Clancy, who was 36 at the time of the deaths, faced three counts of first-degree murder. Judge William Sullivan declared a mistrial on September 4 after jurors failed to reach a unanimous verdict, with the vote splitting 11-1.
